marchandises<\/b>, int\u00e9rieurs et internationaux, qu&rsquo;ils soient <a style=\"background-color: #ffffff; outline: 0px;\" href=\"https:\/\/www.mathezfreight.com\/fr\/services\/transport-maritime\/\">maritimes<\/a>,\u00a0<a style=\"background-color: #ffffff; outline: 0px;\" href=\"https:\/\/www.mathezfreight.com\/fr\/services\/fret-aerien\/\">a\u00e9riens<\/a>, ou terrestres, sont r\u00e9gis par des <b>conventions internationales<\/b> qui limitent la responsabilit\u00e9 du transporteur et du commissionnaire (sauf faute inexcusable). R\u00e9sultat: l\u2019indemnisation d\u2019un sinistre correspond le plus souvent \u00e0 une <b>somme bien inf\u00e9rieure au pr\u00e9judice<\/b> r\u00e9ellement subi.<br \/>Pire encore, si la responsabilit\u00e9 du transporteur ou du commissionnaire n\u2019est pas engag\u00e9e (exon\u00e9ration en <b>cas de force majeure, avarie commune<\/b>), vous ne recevrez <b>aucune indemnit\u00e9<\/b>.<\/p><blockquote><p>Lors d\u2019un transport, si vous ne souscrivez pas d\u2019assurance sp\u00e9cifique, vos marchandises seront transport\u00e9es sous le r\u00e9gime de la limitation de responsabilit\u00e9. Seule la souscription d\u2019une assurance ad-valorem vous couvrira sur sa valeur d\u00e9clar\u00e9e.<\/p><\/blockquote><h2><strong>La limitation de responsabilit\u00e9: une indemnisation au kilogramme<\/strong><\/h2><p>Ce principe de <b>limitation de responsabilit\u00e9<\/b>, pr\u00e9vu par les conventions internationales, est g\u00e9n\u00e9ralement repris dans les <b>Conditions G\u00e9n\u00e9rales de Vente<\/b> de votre op\u00e9rateur de transport logistique.<\/p><p>A titre d\u2019exemple, l&rsquo;indemnisation que vous pourrez obtenir pour tous les dommages \u00e0 vos marchandises imputables \u00e0 toute op\u00e9ration par suite de pertes et avaries et pour toutes les cons\u00e9quences pouvant en r\u00e9sulter,\u00a0sera limit\u00e9e \u00e0 <b>20 \u20ac par kilogramme <\/b>de poids brut de marchandises manquantes ou avari\u00e9es (plafonn\u00e9e par palette). Cette somme est souvent sans rapport avec la gravit\u00e9 du pr\u00e9judice subi!<\/p><h2>Prot\u00e9ger vos biens et valeurs\u00a0\u00ab\u00a0ad valorem\u00a0\u00bb<\/h2><p>Vous avez la facult\u00e9 de souscrire une d\u00e9claration de valeur, appel\u00e9e \u00ab\u00a0assurance <em>ad valorem<\/em>\u00ab\u00a0, qui a pour effet de substituer le montant de cette d\u00e9claration aux plafonds d\u2019indemnit\u00e9. Dans ce cas, et sauf exclusions sp\u00e9cifiques, vous serez indemnis\u00e9 sur la base que vous aurez souhait\u00e9 assurer.<\/p><blockquote class=\"conseil\"><h4>Quelles sont les exclusions de l\u2019assurance \u00ab\u00a0ad valorem\u00a0\u00bb\u00a0?<\/h4><p>Vice propre de la marchandises, influence de la temp\u00e9rature, freinte, insuffisance de l\u2019emballage, faute intentionnelle ou inexcusable du donneur d\u2019ordres, guerre, saisies, contamination nucl\u00e9aire, piraterie, \u00e9meutes, gr\u00e8ve.<\/p><\/blockquote><p>A noter que l\u2019une des raisons les plus fr\u00e9quentes au rejet d\u2019indemnisation par l\u2019assurance dans le cadre d\u2019une couverture ad-valorem, est le d\u00e9faut d\u2019emballage.<\/p><h2>Sp\u00e9cificit\u00e9 maritime: l\u2019avarie commune<\/h2><p>Si votre transporteur maritime fait face \u00e0 un <b>cas de force majeure<\/b> et d\u00e9cide de d\u00e9clencher une <b>proc\u00e9dure d\u2019avarie commune<\/b>, vous pouvez perdre beaucoup d\u2019argent.<\/p><blockquote class=\"conseil\"><h4>L\u2019avarie commune, principe de solidarit\u00e9 et double peine<\/h4><p>La proc\u00e9dure de l\u2019avarie commune, d\u00e9crite d\u00e8s 800 ans avant J\u00e9sus Christ dans des trait\u00e9s de droit romains, exprime la solidarit\u00e9 des gens de mer face aux mauvaises fortunes. Ainsi, en cas d&rsquo;avarie, pour rembourser les marchandises sacrifi\u00e9es sur d\u00e9cision du capitaine en vue de sauver l&rsquo;\u00e9quipage, le bateau et le reste de la cargaison, chacun des propri\u00e9taires doit participer aux frais et pertes \u00e0 proportion des valeurs respectives des biens transport\u00e9s.<br \/>Cette proc\u00e9dure, appliqu\u00e9e par la totalit\u00e9 des pays maritimes, est v\u00e9cue par les propri\u00e9taires de marchandises comme une \u00ab\u00a0double peine\u00a0\u00bb\u00a0: non seulement ils ont parfois perdu leur cargaison, mais ils doivent par ailleurs participer aux frais de sauvetage.<\/p><\/blockquote><p><strong>Et les occurrences sont nombreuses<\/strong>\u00a0! CMA CGM a utilis\u00e9 la proc\u00e9dure de l\u2019avarie commune en f\u00e9vrier 2019, apr\u00e8s l\u2019incendie de son porte-conteneurs Vancouver. Le m\u00eame mois, Hapag-Lloyd a fait de m\u00eame apr\u00e8s l\u2019incendie de son porte-conteneurs Yantian Express.<\/p><blockquote class=\"conseil\"><p>Le 3 janvier 2019, alors qu\u2019il naviguait\u00a0 au large des c\u00f4tes canadienne, en Atlantique Nord, le porte-conteneurs <b>Yantian Express<\/b> \u00e9tait victime d\u2019un violent incendie.
