Our experts have the answers to the main issues faced by importers.<\/p><h2>Covid-19 health supplies<\/h2><p>The health crisis has upset our working lives and bought in new regulations for French companies:<\/p><ul><li><b>The Covid-19 crisis has created new requirements for protecting staff at work.\u00a0<\/b>As employers are responsible for the health and safety of their staff, the health crisis\u00a0 has led to a reassessment of risks and in many cases the <b>mobilisation of new supplies<\/b>: shields, visors, masks, gowns, gloves and hand sanitiser.<br \/>Companies or intermediaries wanting to import these supplies must have a <b>thorough understanding of the customs side of things.<\/b> There are specific checks that customs imposes on devices in line with the <b>Regulations on PPE (Personal Protective Equipment) or MDs (Medical Devices)<\/b>, \u00a0 and these sometimes change and time goes on.<\/li><li>French institutions undertook <b>exceptional measures<\/b> to deal with the health crisis and also the lack of supplies,\u00a0These measures <b>affected the import<\/b><span style=\"font-weight: bold;\">\/export conditions for health supplies\u00a0<\/span> between March\/April and the month of May, and even September\/October 2020. \u00a0Some of these measures were detailed in our article about <a style=\"background-color: #ffffff;\" href=\"https:\/\/www.mathezfreight.com\/fr\/blog\/import-masques-coronavirus\/\">importing masks to France<\/a>. (in French) With the exception of measures relating to VAT, these measures are no longer in effect for the most part. This is particularly true when it comes to the <strong>accepting of equivalents.<\/strong><\/li><\/ul><blockquote><p><strong>All masks and other supplies imported to France must now conform with CE standards.<\/strong><\/p><\/blockquote><p><span style=\"color: #0a4279; font-family: Montserrat; font-size: 24px; font-weight: bold; text-align: left;\">PPE or MDs: what are the customs requirements\u00a0?<\/span><\/p><h3>Whats are the customs&#8217; requirements for CE standard Personal Protective Equipment (PPE) or Medical Devices (MDs). ?<\/h3><p>The regulations are as follows, pending assessment by the customs&#8217; authorities:<\/p><div id=\"mti-list\"><ol><li><div>The manufacturer or their representative within the European Union must provide an <b>EU DOC<\/b> (&#8220;<i>EU Declaration of Conformity&#8221;<\/i>).<br \/>&gt; Example\u00a0<a href=\"https:\/\/ec.europa.eu\/docsroom\/documents\/9781\/attachments\/1\/translations\" target=\"_blank\" rel=\"noopener\">EU Declaration of Conformity<\/a>\u00a0(doc &amp; pdf)<br \/>&gt; Example \u00a0declaration of conformity \u00a0for\u00a0surgical masks\u00a0 and for\u00a0<a href=\"https:\/\/www.mathezfreight.com\/wp-content\/uploads\/doc-declaration-conformite-FFP-marques-ce.docx\" target=\"_blank\" rel=\"noopener\">FFP2 masks<\/a>\u00a0(document to personalise)<\/div><\/li><li><div>The manufacturer\u00a0 must attach the <b>CE Mark<\/b> (followed by the 4 numbers identifying the certified body where applicable, see below) along with the \u00a0\u00a0<b>reference standard <\/b>corresponding to the type of product.<b><br \/><\/b>Ex: <b>NF EN 14683: 2019<\/b> for surgical masks, <b>NF 149 +A1<\/b> for FFP2 masks and so on.<\/div><\/li><li><div>They must also insert a <b>user -manual<\/b> and instructions in French.<br \/>&gt; See\u00a0<a href=\"http:\/\/www.fspf.fr\/sites\/default\/files\/note_dgccrf_notice.pdf\" target=\"_blank\" rel=\"noopener\">Notice from DGCCRF<\/a>\u00a0 on 3rd May 2022, instructions on page 2 and an example on page 3.<\/div><\/li><li><div>They must supply a <i><b>test report<\/b><\/i> or a <b>technical file<\/b> on the reference standard.<br \/>In this way, the manufacturer gets a laboratory evaluation\u00a0 either independently or via a sub-contractor, to ensure their product conforms with the demands of the Directive for MD,\u00a0<a style=\"background-color: #ffffff;\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/PDF\/?uri=CELEX:31993L0042&amp;from=FR\" target=\"_blank\" rel=\"noopener\">Directive 94\/42\/CEE<\/a>, and for PPE, <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/PDF\/?uri=CELEX:32016R0425&amp;from=FR\" target=\"_blank\" rel=\"noopener\">Directive 2016\/425<\/a><a style=\"font-style: italic; font-weight: bold;\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/PDF\/?uri=CELEX:32016R0425&amp;from=FR\" target=\"_blank\" rel=\"noopener\">. <\/a><br \/>&gt; Ex. of\u00a0<i><a href=\"https:\/\/www.mathezfreight.com\/wp-content\/uploads\/doc-test-report-ex.pdf\" target=\"_blank\" rel=\"noopener\">test report<\/a>\u00a0<\/i> for surgical masks<i>.\u00a0<\/i><\/div><\/li><li><div>For <b>medical devices class <\/b><b>IIA, IIB &amp; II,<\/b> and for <strong>PPE<\/strong> <b>categories II and III,<\/b> the manufacturer must also involve a certified body to evaluate the conformity of the products and obtain an <b>&#8220;EU examination certificate type&#8221;<\/b> or <i><b>&#8220;Certificat d\u2019examen UE de type&#8221;<\/b><\/i> and display the certified laboratory number on the product.<br \/><b><span style=\"color: #ff0000;\">Be sure<\/span>\u00a0<\/b> to check that the laboratory that is named on the certificate figures on the <a style=\"background-color: #ffffff;\" href=\"https:\/\/www.mathezfreight.com\/wp-content\/uploads\/doc-liste-organismes-europeens-notifies-chirurgicaux-steriles-dm.pdf\">official list of certified European bodies for medical supplies<\/a>\u00a0 or the\u00a0<a style=\"background-color: #ffffff;\" href=\"https:\/\/www.mathezfreight.com\/wp-content\/uploads\/doc-liste-organismes-europeens-notifies-chirurgicaux-steriles-dm.pdf\">Official list of certified European bodies for PPE<\/a>, according to the required standard.<\/div><\/li><\/ol><\/div><div><div><h3>How can you find out which products are considered &#8220;Medical Devices&#8221; (MDs) Or &#8220;Personal Protective Equipment&#8221; (PPE) and their class?<\/h3><p>To answer the first question you have to work out, &#8220;How the product will be used and where?&#8221;<\/p><ul><li>.\u00a0<span style=\"font-weight: bold;\">Medical Devices (MDs)<\/span>\u00a0 are instruments, devices and products destined to\u00a0<span style=\"font-weight: bold;\">be used by people for medical reasons<\/span>\u00a0 with a main action that is not derived from pharmaceuticals (<i>public health code article L.5211-1<\/i>). They come under\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/PDF\/?uri=CELEX:31993L0042&amp;from=FR\" target=\"_blank\" rel=\"noopener\">Directive 94\/42\/CEE<\/a>, and there are many of them:<span style=\"font-weight: bold; font-style: italic;\">\u00a0<\/span><i>b<\/i>etween 90,000 et 1.5 million different products! From the simple \u00a0thermometer \u00a0to more complex devices like \u00a0defibrillators \u00a0passing by \u00a0surgical staples, dental prosthesis, breathing apparatus, surgical drapes and more. These devices are classified into \u00a04 categories, in line with the potential health risks involved:<br \/><ul style=\"margin-bottom: 20px;\"><li><span style=\"font-weight: bold;\">Class I<\/span>\u00a0&#8211;\u00a0<span style=\"font-weight: bold;\"> the lowest risk<\/span>: masks, examination gloves, over-shoes, crutches, \u00a0compresses (this class is only for \u00a0non-sterile products \u00a0which have no measuring function)<\/li><li><span style=\"font-weight: bold;\">Class IIa<\/span>\u00a0&#8211;\u00a0<span style=\"font-weight: bold;\">moderate\/measured risk:<\/span> thermometers, contact lenses etc.<\/li><li><span style=\"font-weight: bold;\">Class IIb<\/span>\u00a0&#8211;\u00a0<span style=\"font-weight: bold;\">substantial\/high risk<\/span>\u00a0: staples, condoms, sterile masks,<\/li><li><span style=\"font-weight: bold;\">Class III\u00a0<\/span>&#8211;\u00a0<span style=\"font-weight: bold;\">the greatest level of risk<\/span>\u00a0: implants, stents, hip replacement prosthesis etc.<br \/><span style=\"font-weight: bold;\"><span style=\"color: #ff0000;\">Please note:<\/span> <\/span>don&#8217;t confuse the medical class of a device with the\u00a0<span style=\"font-weight: bold;\">classification system of <em>bacterial filtration efficiency \u00a0<\/em>for surgical masks<\/span>\u00a0 as stipulated by standard EN14683\u00a0: 2019.<br \/><i>Type I filters a minimum of 95% of bacteria \/\u00a0Type II\u00a0filters more than 98% of bacteria\/\u00a0Type II \u00ab\u00a0R\u00a0\u00bb \u00a0filters more than 98% of bacteria and is resistant to projections.<\/i><\/li><\/ul><\/li><li>.\u00a0<span style=\"font-weight: bold;\">Personal Protective Equipment (PPE)<\/span> is a device or item that\u00a0<span style=\"font-weight: bold;\">is designed to be carried or worn by an individual to protect them, against one or several risks to their health<\/span>\u00a0<span style=\"font-weight: bold;\">or safety<\/span>, whether that is in their professional or personal life. PPE\u00a0 comes under\u00a0<i><span style=\"font-weight: bold;\"><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/PDF\/?uri=CELEX:32016R0425&amp;from=FR\" target=\"_blank\" rel=\"noopener\">Directive 2016\/425 <\/a>\u00a0<\/span>and <\/i> is categorised in line with the level of risk incurred:<br \/><ul style=\"margin-bottom: 20px;\"><li><span style=\"font-weight: bold;\">Category I\u00a0<\/span>\u2013\u00a0<span style=\"font-weight: bold;\">low risk<\/span>: sunglasses, gardening gloves, rainwear, washing up gloves.<\/li><li><span style=\"font-weight: bold;\">Category II\u00a0<\/span>\u2013\u00a0<span style=\"font-weight: bold;\">high risk<\/span>\u00a0: protective glasses, shoes, boots, visors, gloves and helmets.<\/li><li><span style=\"font-weight: bold;\">Category III \u2013 lethal risk<\/span>: safety harnesses, devices that protect against heat, electricity and chemical attacks, respiratory protection and lifejackets.<\/li><\/ul><\/li><\/ul><p>When working out product usage, you must bear in mind\u00a0<span style=\"font-weight: bold;\">the product&#8217;s main use <\/span>\u00a0in line with\u00a0<span style=\"font-weight: bold;\">the packaging, labelling, user guide and\/or promotional materials <\/span>\u00a0that go with it. Some products may be classed under both categories (see below)<\/p><p><span style=\"color: #0a4279; font-family: Montserrat; font-size: 19px; font-weight: bold; text-align: left;\">What to do if a product has dual-usage\u00a0?<\/span><\/p><\/div><div><p><strong>Some items used within this health crisis may come under both categories MDs and PPE.<\/strong> This can happen, for example with <b>masks, gloves and gowns<\/b>, which are generally used in a medical environment but are now used for personal protection in both working life and personal life. There are also many items of PPE that are used within the health sector (hospitals, laboratories, medical centres etc.) So there may be some confusion with these products as they can perform two functions.<\/p><ul><li><b>Example: \u00a0surgical gloves.<\/b>\u00a0 In general, examination gloves and surgical gloves are medical supplies, but the manufacturer could also decide they were designed to protect their user.<\/li><\/ul><p>If a product has this dual use, it should <b>conform with the demands of both directives<\/b>. This is an integral part of your duty and makes up part of the occasionally strict checks carried out by customs.<\/p><\/blockquote><p><strong>Surgical \u00a0masks<\/strong> seem to be the most common imported category of mask nowadays. For this reason, on the\u00a0 17th June 2020, the DGCCFR published a\u00a0<a href=\"https:\/\/www.mathezfreight.com\/wp-content\/uploads\/doc-note-masques-chirurgicaux.pdf\" target=\"_blank\" rel=\"noopener\">notice for professionals<\/a>, which was aimed at reminding importers of their labelling obligations if they want to sell their product on the French market.<\/p><h3>Medical device: do you speak French\u00a0?<\/h3><p>It&#8217;s mandatory for any <b>labels<\/b> on a medical device that&#8217;s to be handed over to the end-user or patient to have a <b>French-language version<\/b> along with the <b>user-manual<\/b> that goes with it, and any other information required for its use, (R.5211-20 of the Public Health Code).<\/p><h3>Medical devices: electronic user manuals\u00a0?<\/h3><p>Some would like to replace the printed user manual with a digital download.
